MINUTES OF MILFORD CITY COUNCIL REGULAR MEETING
MILFORD CITY COUNCIL CHAMBERS
26 SOUTH 100 WEST, MILFORD, UTAH
TUESDAY, SEPTEMBER 4, 2007 7:00 PM
Mayor Eugene H. Mayer called the Regular Meeting to order at 7:00 p.m.
MAYOR’S WELCOME AND ROLL CALL
Present: Mayor Eugene H. Mayer, Council Members Cullen Carter, Nolan Davis, Troy Netto, Bryan Sherwood, and Russell Smith, City Manager Nedra Kennedy, City Recorder Monica Seifers, and City Foreman Tom Bradshaw.
Absent: City Engineer April McKeon, City Attorney Leo Kanell, and City Treasurer Arden Fowles
Visitors: Jackalyn McKissack, Antonio McKissack, and Camille Carter – Request for Speed Control. Bill and Sarah Wray – General Interest
RECOGNITION AND RESPONSE TO VISITORS RELATING TO CITY BUSINESS
Jackie McKissack – Discuss Intersection of 900 South and 200 West
Mrs. McKissack requested a stop sign, yield sign, or children at play signs at the intersection near her home. She explained that the traffic has increased substantially with the extension of 900 South to Highway 21 and the residents in the area are concerned with the traffic and also with speeding. The intersection behind Camille Carter was also addressed: there are five roads that come together and there no yield or stop signs. Council Member Bryan Sherwood commented that he did not have a problem with placing children at play or speed limit signs on 900 South. Mrs. Carter stated she has turned in several speeders. Antonio McKissack stated he had contacted the sheriff’s department but he continues to see problems with kids using the overpass as a ramp for their bicycles and skating shoes. Mayor Eugene Mayer stated he would work on enforcement by the sheriff’s department. Council Member Nolan Davis stated that there needed to be signs placed and enforcement of the speed limit but at the same time the parents of children in the neighborhood need to educate their children.
MOTION: Council Member Bryan Sherwood moved to approve the purchase and placement of four “Children at Play – 25 mph” signs to be placed in the area. Motion seconded by Council Member Nolan Davis and carried unanimously.
CONSENT ISSUES
MOTION: Council Member Troy Netto moved to approve the consent issues including the bills and payroll, Minutes of August 21, 2007 Public Hearing and August 21, 2007 Regular Meeting. Motion seconded by Council Member Cullen Carter and carried unanimously.
NEW BUSINESS
Mutual Aid Agreement for Utah Water and Wastewater Agencies
Foreman Tom Bradshaw recommended participating.
MOTION: Council Member Troy Netto moved to approve the Mayor, City Recorder and Attorney to sign the Mutual Aid Agreement contingent upon approval by Attorney Kanell. Motion seconded by Council Member Russell Smith and carried unanimously.
Bids for Replacement of Library Stairs
Mayor Eugene Mayer opened the first bid received from Brandon Payne at $3,340.99. A second bid, received from Wright Way Concrete at $3,600.00, was opened. Council Member Bryan Sherwood asked if Brandon Payne was licensed and bonded. City Manager Nedra Kennedy replied that the contractor would have to sign an indemnification form and the staff would have to determine if he had proper licensing. City Manager Kennedy to check on the licensing status for Mr. Payne.
MOTION: Council Member Nolan Davis moved to accept the bid of $3,340.99 by Brandon Payne contingent upon his licensing status, otherwise bid will be rewarded to Wright Way Concrete. Motion seconded by Council Member Troy Netto and carried unanimously.
Recommendation for Zoning Administrator/Treasurer
Council Member Cullen Carter reported interviews had been conducted and the offer went to Makayla Bealer.
MOTION: Council Member Cullen Carter moved to approve the hire of Makayla Bealer as Zoning Administrator and Treasurer. Motion seconded by Council Member Nolan Davis and carried unanimously.
Camille Carter left at 7:35 pm
OLD BUSINESS
Sale and Negotiation of Surplus Properties
Council Member Bryan Sherwood commented there should be stipulations set on the use of the lots. He also requested that the lots be staked as per the survey.
Final Approval of Sunnyside Subdivision
City Manager Kennedy reported that Attorney Kanell was not in attendance because of the service district meeting regarding the hospital. Mr. Kanell had been asked to draft the land sale agreement as requested by the buyer. (See reports & comments).
REPORT & COMMENTS
· Council Member Troy Netto inquired if there had been any problems with the swim pool leaking this summer. Foreman Bradshaw stated that Missy Rose reported that there was plaster coming off but no other problems had been reported. Council Member Netto asked that the issue be addressed before summers end. City Manager Kennedy will follow up.
· Council Member Troy Netto reported he would not be attending the September 18th Council Meeting.
· Council Member Troy Netto asked if there were any funds left for chip sealing, Foreman Bradshaw replied that the project was complete.
· Council Member Bryan Sherwood inquired about the speed limit on Main Street. City Manager Nedra Kennedy and Council Member Nolan Davis explained that a traffic study would be completed but may not result with a reduction in speed limit; there is a possibility that the speed limit will be increased following the study.
· Council Member Bryan Sherwood asked City Manager Nedra Kennedy to follow up on the school crossing guards. City Manager Kennedy reported she had been communicating with the schools.
· Council Member Troy Netto asked City Manager Nedra Kennedy to contact the Beaver County Sheriff’s Department regarding the work release program.
Attorney Kanell entered at 7:50 PM
Attorney Kanell presented a final acceptance letter for Sunnyside Subdivision to City Manager Kennedy; she will copy the members of the council.
Mr. Kanell reported that a location has been selected north of town for the new hospital.
ADJOURNMENT
As there was no further business, the meeting adjourned at 8:27 p.m.
