MINUTES OF MILFORD CITY
PLANNING AND ZONING COMMISSION MEETING
26 SOUTH 100 WEST, MILFORD, UTAH
WEDNESDAY, SEPTEMBER 12, 2007 7:00 PM

The Milford City Planning and Zoning Commission meeting was called to order by Chairman Pro-Tem Beebe at 7:07 p.m.

Present: Chairman Pro-Tem Cory Beebe; Commissioners Robert Shaw, Shaun Higgins, Terry Wiseman and John Killam; Zoning Administrator, Arden Fowles and Makayla Bealer.

Absent: Chairman Robert Thieme and Commissioner Cullen Carter

Visitors: Lana Shaw; Michael Barnes– Proposing the development of small business/s on south Main Street.

CONSENT ISSUES

Review and approval of the regular meeting minutes of August 8, 2007.

MOTION: Commissioner Shaw made a motion to approve the minutes as written, Commissioner Wiseman seconded the motion, and all were in favor. The motion passed unanimously.

CONDITIONAL USE PERMITS

Review and action as necessary regarding a preliminary site plan and design review with Michael Barnes who will be proposing the development of small business/s on south Main Street.

Michael Barnes proposed to the Planning and Zoning Committee with the idea to develop a Car Wash and a Pizza Restaurant in the Main Street Commercial (MSC) expansions area on the approach to the new viaduct between 600 and 700 South. The structure that currently sits on the property will be tore down and a new building will be built.

The car wash will be one automatic bay, one bay for semi trucks and trailer, and two self serve bays in the north end of the lot with two entrances.

Questions and Issues that will need to be addressed and/or finalized prior to issuing Conditional Use Permits and other applicable permits:

• The property is abutting a Residential Zone, we need to consider noise and traffic frequency – Michael informed the committee that the car wash would be using a system called the Whisper, which is the most quiet car wash system.
• The access water will be drained into the sewer system
• Planning on using 150-200 thousand gallons of water a month.
• Check on the easements for putting asphalting the alleyway, since many people would use it for an entrance and it would control the weeds.
• Draining Issues
• Curb, gutter and sidewalks
• Parking arrangements

The Pizza Restaurant will be placed on the south end of the lot. The Pizza Restaurant will be a 30 by 40 foot steel building with brick or rock décor on the front of building. This will not require a Conditional Use Permit, due to it being a retail store.

No plans were presented to the committee, due to the architect being out of town. When Mr. Barnes receives the plans and is ready to get permits, he will notify the city and make arrangements to attend a follow up meeting with Planning and Zoning to present the plans.

COMMISION REPORTS AND COMMENTS

Arden Fowles, Zoning Administrator reported the following:

• Utah League of Cities and Towns was contacted, they informed Milford City that it is illegal to alter the conditions of a permit unless the permit holder petitions for an expansion or changes the use.
• Mike’s Tire and Oil - - Conditional Use Permit
o Arden is going to talk with Michael Mayer personally to get the problems resolved of storage and lot development concerns.
• Sherwood’s RV Park - - A Conditional Use Permit was never issued. The City Council approved a variance on September 6, 1983. This will take some additional investigation on how to proceed.
• The site north of True Value has been selected for the new hospital.
• The following properties have been purchased for development:
o 468 South Main S ½ Lot 3, Block 12 “B”
o 470 South Main N ½ Lot 4, Block 12 “B”
o 474 South Main S ½ Lot 4, Block 12”B”
o 435 South Main


ADJOURNMENT

As there was no further business, Chairman Pro-Tem Beebe adjourned the meeting at 7:40 p.m.
