MINUTES OF MILFORD CITY PLANNING AND ZONING COMMISSION
PUBLIC HEARING
MILFORD CITY COUNCIL CHAMBERS, 26 SOUTH 100 WEST, MILFORD, UTAH
Wednesday, April 11, 2007, 6:45 p.m.


The Milford City Planning and Zoning Commission Public Hearing was called to order by Chairperson Thieme at 6:45 p.m.

Present were, Commission Chair: Bob Thieme, Members: Cory Beebe, Cullen Carter, Bonnie Hardy, Shawn Higgins, Robert Shaw and Terry Wiseman; Zoning Administrator, Arden Fowles. Visitors: Phyllis Mayer, Lana Shaw, Dee Chidester, Steve Austin, Bill Romine, Robert Johnson, Tammy Willis, Margaret Miller, Troy Netto, Sharon Larsen (all visitors are property owners in the affected area of the proposed zoning change).

Chairman Thieme began by reading the posted purpose of the meeting, which was “to hear public comment on the subjects of amending a portion of a commercial zone usage and rezoning a segment of Milford City from residential to commercial, approximately from the alleyway between Main Street and 100 East, east to the rail line and approximately 50 North, northward to the city limits. These proposals will extend the present commercial district a short distance east of its present boundary and allow better flexibility of land use in that particular area”.
He then read, by request, the uses, both permitted and conditional under the proposed change.

Bill Romine asked if the Commission didn’t have the latitude to simply use their conditional use authority to deal with issues that would arise in the area being discussed. Mr. Thieme agreed that it did and has used that authority in some occasions and quoted an item that allows the commission to act on a basis of the use being “in harmony” with the area.
Several comments were made out of order; 1) Margaret Miller asked if spot zoning couldn’t be used?
2) Bill Romine said that businesses have cropped up in homes around town.
Mr. Thieme explained that the commission didn’t want to continually keep coming back to deal with conditional use permits in an area that could have the problem mitigated by zoning procedures.
Open discussion ensued regarding the proposed lines of change as described in the purpose of the meeting.
Margaret Miller stated that she and her husband were opposed to any rezoning of the area that it was one of the nicer residential areas in town and there was land to the north and to the west that could be used.
Mr. Thieme recapped by saying that what he was hearing was that they were not opposed to the idea that the Mayer’s have of putting a storage facility on the land, but were not so willing to have it developed by other and unknown sources or rezoned. The group indicated general agreement with that.
