MINUTES OF MILFORD CITY
PLANNING AND ZONING COMMISSION MEETING
26 SOUTH 100 WEST, MILFORD, UTAH
WEDNESDAY, OCTOBER 10, 2007 7:00 PM

The Milford City Planning and Zoning Commission meeting was called to order by Chairman Pro-Tem Beebe at 7:07 p.m.

Present: Chairman Pro-Tem Cory Beebe; Commissioners Shaun Higgins, Terry Wiseman, John Killam, Cullen Carter; Zoning Administrator, Makayla Bealer

Absent: Chairman Robert Thieme and Commissioner Robert Shaw

Visitors: Bill and Sara Wray

Chairman Pro-Tem Beebe informed the commission that Robert Thieme resigned from the Planning and Zoning Commission effective today.

CONSENT ISSUES

Review and approval of the regular meeting minutes of September 12, 2007.

MOTION: Commissioner Higgins made a motion to approve the minutes as written, Commissioner Wiseman seconded the motion, and all were in favor. The motion passed unanimously.

NEW BUSINESS

Review, Discussion and Action Concerning Wind Turbine.

The state would like to put up a Skystream 3.7 wind turbine at the UDOT shed that will be on a 45-foor mono-pole (non guyed). They have requested a letter from the city stating that we don’t require any permits for turbines. Makayla Bealer has reviewed both the Zoning Ordinance and the Airport Influence. Milford City does not have an ordinance on wind turbine and the airport influence will not be affected, therefore zoning or permitting issues will not apply to the state.

The state is exempt from our local laws, but Makayla Bealer can see there being an increase in the future of people wanting to experiment with wind turbines and would like to get the policy and procedure in place before precedents are set.

The Planning and Zoning Commission requested that Circleville and other communities in Utah be contacted to get ideas on what should be in the ordinance, so we can implement an ordinance for wind turbine.

Review and Action Regarding Zoning Issue at 33 North 500 West.

The Planning and Zoning issue with the carport at 33 North 500 West was turned over to Milford City’s Attorney, Leo Kanell. Following Mr. Kanell’s Advice, the Board of Adjustment issued a variance for Mr. Rose’s carport.

Review and Action as Necessary Regarding Open Conditional Use Permits.

Makayla Bealer reported that she could not find any documents that were sent to Michael Mayer regarding his conditional use permit. Therefore Les Whitney, Beaver County Fire Chief, and herself met on Michael Mayer’s Conditional Use Permit. After reviewing the CUP and the property, a letter will be sent to Mr. Mayer informing him of his violations that the commission discussed in their Planning and Zoning meeting that was held on August 8, 2007. The following was found to be in violation with Mr. Mayer’s conditional use permit:

1. Traffic Ingress and egress will not adversely affect the general traffic patterns of the area.

2. Parking facilities and location will not adversely affect internal circulation or access public streets. Parking area will be paved and lined so as to aid in proper circulation.

3. Building design, landscaping, lighting, signage and parking facilities will be compatible with or complimentary to already established adjacent structures and lots and not adversely affect the general residential characteristic of the zone.

4. Landscaping in accordance with section 13.33 will be the minimum requirement (15%) for the off street open, parking area and due to the nature of the residential characteristic of the area it is also necessary to invoke section 13.17.4 which requires all setbacks to be landscaped.

5. All outside storage will be fenced for privacy.

6. Site will be kept clean, free of debris, and consistently well maintained.

7. As per the International Fire Code, the used tire storage is prohibited in the current manner they are being stored. Also as a requirement of his building permit occupancy; curb, gutter and sidewalk is required and needs to be place along 100 south.

Chairman Pro-tem Beebe asked Ms. Bealer to look into the Sherwood RV Park, since the park was issued a variance instead of a CUP and on how to proceed.

COMMISION REPORTS AND COMMENTS

Makayla Bealer, Zoning Administrator reported the following:

• A pre existing mobile home that was located at 347 South 500 West has been moved from that location and moved into the mobile home park located at 234 South 500 West without notifying Milford City. The mobile home is not HUD certified and cannot be placed on any mobile home park. The property owner will be notified to have this mobile home removed off the premises.

Commissioner Killam requested that the Planning and Zoning commission investigate on how the access water must be discarded, either by draining into the sewer system or by a recycle system for the car wash that Michael Barnes proposed to the committee on September 12, 2007.

ADJOURNMENT

As there was no further business, Chairman Pro-Tem Beebe adjourned the meeting at 7: 52 p.m.
