MINUTES OF MILFORD CITY
PLANNING AND ZONING COMMISSION MEETING
26 SOUTH 100 WEST, MILFORD, UTAH
WEDNESDAY, MAY 14, 2008 7:00 PM

The Milford City Planning and Zoning Commission meeting was called to order by Chairman Beebe at 7:12 p.m.

Present: Chairman Cory Beebe; Commissioners Terry Wiseman, Malina Stewart, and Lisa Carter; Zoning Administrator, Makayla Bealer.

Absent: Commissioner Cullen Carter, Shaun Higgins, John Killam

Visitors: Andy Swapp – Wind Turbine Systems

RECOGNITION AND RESPONSE TO VISITOR

Andy Swapp – Wind Turbine Systems

Mr. Swapp explained to the commission that wind turbines are an effective way to produce energy. He stated his class and himself have done studies in Milford to locate where wind turbines will produce wind energy at there potential. The study shows that the ideal location for wind turbines is on the west end of Milford City. Mr. Swapp educated the commission on the height of the wind turbines located at the Milford High School and Milford Elementary School. He also informed the commission that wind turbines are not necessarily made to be located in city limits; however he feels that if you allow wind turbines within city limit; use the setbacks provided in the Wisconsin Ordinance. Mr. Swapp provided the commission with a Draft Model Wind Ordinance for Wisconsin. He recommended to commission to consider using information from the Wisconsin Ordinance, so that wind turbines are allowed in city limits, but under strict guidelines and regulations.

CONSENT ISSUES

Review and approval of the regular meeting minutes of January 9, 2008.

MOTION: Commissioner L. Carter made a motion to approve the minutes as written, Commissioner Stewart seconded the motion, and all were in favor. The motion passed unanimously.

OLD BUSINESS

Review, Discuss and Action on Legislation for RM6S, RM and Wind Turbines

The commission reviewed the ordinances for RM, RM6S, and Wind Turbines which were provided in the packets.

Commissioner Stewart recommended that chain link fences be prohibited in the RM6S District and public or private schools be prohibited on dead end streets and cul-de-sac in the RM District. The commission agreed with the recommended changes.

Next the commission reviewed the Wind Ordinance for Wisconsin. Chairman Beebe recommended using the setbacks located in the Wind Ordinance for Wisconsin that states:

Setbacks: The following setbacks and separation requirements shall apply to all Wind Turbines; provided, however, that the Committee may reduce the standard setbacks and separation requirements if the intent of this Ordinance would be better served thereby.
a. Inhabited structures: Each Wind Turbine shall be set back from the nearest residence, school, hospital, church or public library, a distance no less than the greater of (a) two (2) times its Total Height or (b) one thousand (1,000) feet.
b. Property lines: Each Wind Turbine shall be set back from the nearest property line a distance no less than 1.1 times its Total Height, unless appropriate easements are secured from adjacent property owners, or other acceptable mitigation is approved by the Committee.
c. Public Roads: Each Wind Turbine shall be set back from the nearest public road a distance no less than 1.1 times its Total Height, determined at the nearest boundary of the underlying right-of-way for such public road.
d. Communication and electrical lines: Each Wind Turbine shall be set back from the nearest above-ground public electric power line or telephone line a distance no less than 1.1 times its Total Height, determined from the existing power line or telephone line.

The commissioners discuss and determined by using the setbacks from the Wisconsin Ordinance would allow wind turbines in city limits, but with strict guidelines and regulations.

The Ordinances will be changes and provided to the commission at the meeting on June 11th.

MOTION: Commissioner Wiseman made a motion to hold a public hearing on June 11th at 6:30 pm to address comments and concerns relating to Residential Medium Special District, Residential Medium District and Wind Turbine Legislation, Commissioner L. Carter seconded the motion, and all were in favor. The motion passed unanimously.


COMMISION REPORTS AND COMMENTS

Makayla Bealer, Zoning Administrator reported the following:

John Killam resigned from the Planning and Zoning Commission on May 8, 2008 due to medical reasons.

Commissioner Beebe requested that the Conditional Use Permit for Lost and Found Youth Academy be reviewed to determine if the conditional use permit conditions are in compliance.


ADJOURNMENT

As there was no further business, Chairman Beebe adjourned the meeting at 9:00 p.m.
