MINUTES OF MILFORD CITY
PLANNING AND ZONING COMMISSION MEETING
26 SOUTH 100 WEST, MILFORD, UTAH
WEDNESDAY, DECEMBER 12, 2007 7:00 PM
The Milford City Planning and Zoning Commission meeting was called to order by Chairman Pro-Tem Wiseman at 7:10 p.m.
Present: Chairman Pro-Tem Terry Wiseman; Commissioners, Cory Beebe, John Killam, Cullen Carter; Zoning Administrator, Makayla Bealer.
Absent: Commissioner Shaun Higgins
MOTION: Commissioner Beebe made a motion to appoint Commissioner Wiseman as pro-Tem, Commissioner Killam seconded the motion.
CONSENT ISSUES
Review and approval of the regular meeting minutes of October 10, 2007
MOTION: Commissioner Beebe made a motion to approve the minutes as written, Commissioner Killam seconded the motion, and all were in favor. The motion passed unanimously.
NEW BUSINESS
Robert Shaw Resignation from the Commission
Chairman Wiseman stated that Robert Shaw has resigned from the Planning and Zoning Commission, due to him relocating.
MOTION: Commissioner Carter made a motion to accept Robert Shaw’s resignation from the Planning and Zoning Commission, Commissioner Beebe seconded the motion, and all were in favor. The motion passed unanimously.
Recommendations for Planning and Zoning Vacancies
Chairman Pro-Tem Wiseman stated that Lisa Carter and Malina Stewart have contacted the City Office and have shown some interest in serving on the Planning and Zoning Commission.
MOTION: Commissioner Beebe made a motion to recommend Lisa Carter and Malina Stewart to the City Council to serve on the Planning and Zoning Commission, Commissioner Killam seconded the motion, and all were in favor. The motion passed unanimously.
Appoint of Chairman
MOTION: Commissioner Carter made a motion to hold off on appointing a chairman until the meeting held in January, so the new members of the committee can vote on the chairman, Commissioner Killam seconded the motion, and all were in favor. The motion passed unanimously.
Discuss RM6S Zone and Rezoning 800 S to the Highway Commercial District on 700 West; on the west side of the street.
Makayla Bealer stated that currently Milford has two residential zones that are being used, RM6S zone is located along 700 West on the west side of the street out to the golf course and any other residential area in Milford is zoned as a RM6. In Milford Municipal Code 13.14 (Medium Residential District), both RM6S and RM6 are located in this section of the code; and refer to the Residential Low District in section 13.13. Residential Low District currently is not a zone within Milford City limits. It has been brought to my attention that the planning and zoning committee may want to consider making RM a standalone zone that doesn’t refer to the RL zone and make RMS a standalone zone with restrictor guidelines.
Currently RM6S allows all the permits and conditional uses in a Residential Medium except for Town Homes and Duplexes. If RM6S has stricter guidelines then the golf course area would be the one place in Milford were only residential home are allowed without businesses.
Makayla Bealer stated that the city has been contacted about a developer wanting to develop the land around the golf course, no plans have been made, but they would like to put condominiums along hole 1. Currently condominiums are not a permitted use in the RM6S zone.
Commissioner Carter recommended that the commission review the CCNR for the Ironwood subdivision on the south side of the street on 900 south and use some their guidelines to make the RM6S a strict zone. Ms. Bealer will provide that information for review at the next meeting.
Ms. Bealer stated that when making the RM6S a stricter zone may cause us to rezone from 800 south to the (HC) on the west side of the street on 700 West to RM6.
Commissioner Carter stated that the two largest property owners in the RM6S are Advance Development and Beaver County School District.
The Planning and Zoning Commission will have further discussion at the next meeting to consolidate information and then possibly schedule a public hearing.
OLD BUSINESS
Discuss Wind Turbine Legislation
The planning and zoning commission reviewed the information from Bruce Parker that he put together for Wayne County. Commissioner Beebe stated that he felt that the information is very well put together.
Ms. Bealer recommended that the commission review the information more in depth within the next month. The commission will make notes of different things that they feel needs to be added or removed and then the Planning and Zoning Commission will have further discussion at the next meeting to consolidate information on the wind turbine ordinance.
COMMISION REPORTS AND COMMENTS
Commissioner Beebe requested an update on the hospital. Commissioner Carter stated the architectural drawings have been received. They are working on approving the plans, and then the plans will go out to bid. They plan on breaking ground in March.
Commissioner Cullen requested an update on Michael Mayer’s CUP. Ms. Bealer stated Mr. Mayer was sent a letter notifying him of his violations. Mr. Mayer as contacted the City Office informing them of his plan to bring his property to compliance. Mr. Mayer has corrected the parking problem, by painting lines. Michael is in the process of purchasing a trailer for removing the tires from the property to a recycling facility. The landscaping will be done in the spring.
Commissioner Killam reported that the railroad property along Main Street needs to cleaned up free of railroad ties and the cement structure. Ms. Bealer stated that the railroad has recently been cleaning up the property and the beautification board is keeping an eye on this and if the problem is not corrected in the spring then a letter of violation will be sent to the railroad. Commissioner Killam also reported that he feels some action needs to be taken on Ken Bettridge Tanks on the east side of the railroad tracks. Ms. Bealer will take these comments to the Beautification Board.
Makayla Bealer stated I have been informed by Bruce Parker that in the Milford Municipal Code in section 13.36.100. Use permit to run with the land is illegal; the CUP runs with the land and are not personal to the applicant. I’ve contacted the league for legal advice and am waiting to hear back.
ADJOURNMENT
As there was no further business, Chairman Pro-Tem Wiseman adjourned the meeting at 8:20 p.m.
