MINUTES OFMILFORD CITY COUNCIL PUBLIC HEARING
MILFORD CITY COUNCIL CHAMBERS
26 SOUTH 100 WEST, MILFORD, UTAH
TUESDAY, AUGUST 21, 2007 6:45 PM

Present: Mayor Eugene H. Mayer, Council Members Nolan Davis, Bryan Sherwood, and Troy Netto, City Manager Nedra Kennedy, Treasurer Arden Fowles, City Recorder Monica Seifers and Attorney Leo Kanell.

Absent: Council Members Cullen Carter and Russell Smith

Mayor Eugene H. Mayer called the public hearing to order at 6:45 p.m.

The purpose of the public hearing was to hear comments on the proposed amendments to the Milford City Zoning Ordinance, specifically chapters dealing with Landscaping (13.33 Landscaping and 13.34 Yards & Setbacks).

Mayor Eugene Mayer called for comments.
Zoning Administrator Arden Fowles explained the disparities between the two ordinances and the difficulties with enforcement which resulted in the Beautification Board asking the Planning and Zoning Commission to review them. The Planning and Zoning Committee reviewed the ordinances and determined they were contradictory. One of the original ordinances had been intended for commercial use with the other pertaining to residential districts. The new ordinances were separated and defined. The biggest change was to the residential code, which would allow property owners the freedom of using hardscaping; the current code did not give that option. There are a couple of properties that have recently put in natural landscaping, and although they looked nice, the way the code was written they were non-compliant. The proposed ordinance gives more landscaping options to property owners while enabling better enforcement of the code.

Council Member Sherwood inquired if Ordinance 10-2007 “Regulation and Standards for Landscaping” referred to commercial zones. Administrator Fowles replied that the proposed ordinances treated all non-residential districts separate from single family and multi family residential and Ordinance 10-2007 was for commercial use. Council Member Sherwood asked if 15% live plant landscaping would apply to previously developed lots on Main Street where parking space is limited. Administrator Fowles and Attorney Kanell explained that pre-existing lots and newly developed lots would be treated accordingly. Pre-existing lots could be dealt with on a case-by-case basis as the proposed site plans were presented to the governing body.

As there were no further comments the public hearing adjourned at 6:59 p.m.
