MINUTES OF BEAUTIFICATION BOARD MEETING
TUESDAY, APRIL 17, 2007
26 SOUTH 100 WEST, MILFORD, UTAH
6:00 PM

Chairman Whitney called the meeting to order at 6:02 p.m.

Present: Chairman Les Whitney, Board Members Eugene Mayer, Nolan Davis, Bryan Sherwood and Monica Seifers.

Absent: None

Visitors: Sarah Wray

CONSENT ISSUES
Approval of minutes from February 20, 2007.

MOTION: Board Member Eugene H. Mayer moved to approve the minutes of the February 20, 2007 regular meeting. Motion was seconded by Board Member Nolan Davis and carried unanimously.

NEW BUSINESS
1. Review and Discuss Administrative Orders
· Notice of Violation
· Notice of Failure to Abate Violation – Ten Day Final Notice
· Notice of Compliance

Monica Seifers stated that the board had previously discussed adding verbiage to the administrative orders regarding issuance of citations through the Beaver County Sheriff’s Office if the responsible person failed to comply with the order. She explained that once the Notice of Violation has been delivered and the 10 day appeal period has passed, the responsible person has waived their right to an appeal hearing and if the violation is not corrected by the expiration date of that notice, the city can begin civil or legal proceedings. Mr. Sherwood stated that it will only take a few citations being issued and residents would realize the city is serious about enforcement.

MOTION: Bryan Sherwood moved to add a disclaimer to the administrative orders. Motion seconded by Eugene Mayer and carried unanimously.

2. Report Properties for Review of Violation
Ms. Seifers reported that she was compiling a list of properties to prepare notices for weed abatement. The city office received a complaint regarding the residence at 550 South 100 West for absence of landscaping, they have allowed the lawn to die leaving weeds and dirt. Ms. Seifers explained that this is a common problem throughout the city and is difficult to enforce. Chairman Whitney asked if there was an ordinance regarding landscaping. Ms. Seifers reported that there is a zoning ordinance that requires a percentage of the front and side yards to be planted in live material and maintained. Chairman Whitney pointed out that we have a few residences that have gone with desert landscape, which would be in violation of the zoning ordinance, although they do look better than the lots that have been stripped or have weed growth. After board discussion regarding the amount of live material required in the zoning ordinance, Ms. Seifers stated that the ordinance should be reviewed by the Planning and Zoning Commission and suggested that the Beautification Board request P&Z Commission review the landscaping ordinance to see if could be revised to allow more options for landscaping to prevent weeds and loose dirt. Chairman Whitney asked what the conditional use permit for Richard McDermott’s storage sheds in industrial park covered, Mr. Whitney has received a few complaints regarding the trailers and vehicles parked on the property, he would like to know what restrictions the CUP has placed on the use. Ms. Seifers stated that P&Z issued the CUP’s and should review them annually but she could not say when the last review of Mr. McDermott’s CUP was done. Mr. Davis stated he thought the CUP’s were supposed to have been reviewed last fall with all permits being required to be in compliance before issuance of licenses. Ms. Seifers reported that the Beautification Board has made several attempts through administrative orders as well as the Industrial Park Protective Covenants and there has been absolutely no compliance. Chairman Whitney asked that the Beautification Board request to be placed on the May 9, 2007 P&Z agenda for discussion of the zoning ordinance and CUP’s.

Board Member Reports
· Ms. Seifers reported the two properties previously in violation, Ilene Rollins and Richard McDermott’s Trailer Park on 500 South and 600 West, have made corrections and are currently in compliance.
· Mr. Mayer reported he would like to see the P&Z Commission revise the ordinance to prevent property owners from leaving barren land when removing weed violations. The landscaping code needs to be more descriptive.
· Chairman Whitney asked if current codebooks were available. Mr. Whitney was advised that he could obtain updated codes in the city office.

MOTION: Bryan Sherwood moved to adjourn at 6:45 p.m. Motion seconded by Eugene Mayer and carried unanimously.
